Terms & Conditions

It is our endeavor to always serve you to your complete satisfaction. This also includes our fair terms and conditions. We only supply brand new products in original brand quality.

The contract is concluded when we accept the contract offer made by your order through our order confirmation. This order confirmation contains the essential contents of your order.

In the case of orders placed on account, we reserve the right to ship the order only after the correctness of the customer data provided has been checked.

Tamar Trade GmbH reserves the right not to accept the order without giving a reason.

1. Refusal of acceptance

In the event of an unjustified refusal to accept the goods delivered by us, we will charge the costs incurred by us.

2. Data protection

Tamar Trade GmbH only records the absolutely necessary data and uses it in the context of the processing of the order and with the purpose of making shopping as easy as possible for the returning customer.

The personal data will be treated confidentially by Tamar Trade GmbH in accordance with the data protection legislation.

Tamar Trade GmbH does not pass on any data to third parties. Your data will not be used for third-party advertising or resold under any circumstances.

3. Retention of title

The delivered goods remain our property until full payment has been made.

4. Warranty

The warranty is two years after delivery and is limited to defects that occur that can be proven to be due to material, workmanship or design defects on the part of the supplier.

5. Place of jurisdiction

Our business activities are based exclusively on Swiss law. The place of jurisdiction is Winterthur.

We are also entitled to sue at your general place of jurisdiction.

6. Warranty/Liability

In the case of the delivered goods, liability is limited to a repair or replacement delivery. Statutory claims are excluded. Claims for rescission of the contract or reduction of remuneration are excluded, provided that a replacement delivery is possible within a reasonable period of time.

Objections due to defects in the goods can be made within 3 days, provided that the goods are new and unused. If the inspection of the defective goods shows that the defects are due to culpable conduct on the part of the buyer (e.g. damage due to improper handling), the buyer shall bear the costs of the replacement delivery.

Glassware of any kind is completely excluded from warranty and liability.
Glass/ceramic goods and electronic cigarettes are covered by a DOA (dead on arrival) warranty

Our liability for our own fault, as well as that of our legal representatives and vicarious agents, is limited to intent and gross negligence. This does not apply to the breach of essential contractual obligations and the lack of warranted characteristics.

Please note that we are therefore unable to take back plants, cigars, personalized items of any kind (soccer shirts, home shirts, etc.), as well as underwear and bed linen for hygienic reasons. Also excluded from the right of return for copyright reasons are software, multimedia products, sound carriers, videos and DVDs

A return of defective items is only possible in original packaging, with a completed warranty certificate and invoice receipt, otherwise no warranty claim is possible.

7. Purchase on account with instalment payment option (PowerPay)

Orders against invoice (PowerPay) are accepted exclusively via the websites www.tamarheadshop.ch, www.tamargrowshop.ch and www.cbd.ch and are exclusively for customers of legal age. If it is determined after the confirmation of receipt of the order that an item is not available, the corresponding order will be adjusted and cancelled if necessary. The customer cannot assert any further claims.

In the case of purchase on account (PowerPay), the customer is obliged to pay the invoice amount within 10 calendar days of receipt of the delivery, otherwise the instalment payment option will apply.

MF Group / PowerPay offers the payment method "Invoice from PowerPay" as an external payment service provider. With the order invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified time frame, you will receive a monthly invoice with an order summary in the following month.

When concluding the purchase contract, PowerPay takes over the invoice claim and processes the corresponding payment modalities. If you purchase on account, you accept the terms and conditions of PowerPay (powerpay.ch/de/agb) in addition to our terms and conditions.

8. Debt collection

After the expiry of the payment period, the customer is automatically in default. Tamar Trade GmbH is entitled to charge reminder costs of up to CHF 20 per reminder. The outstanding invoice amount plus any reminder fees and interest may be handed over or assigned to Intrum Justitia AG for the purpose of collection. In this case, at least CHF 50 reminder fees will be incurred. Furthermore, the customer is obliged to reimburse all costs incurred by Tamar Trade GmbH or Powerpay as a result of the delay in payment.

9. Terms of delivery

Please note the delivery times indicated on our site for the respective product. These are empirical values, but they can vary due to residues. A delay in delivery never leads to a reduction in the sales price.

In order to deliver the goods as quickly as possible, we also make partial deliveries. There are no additional costs for you. Delivery is by post.

In principle, deliveries are made by A Mail, letter or parcel, with the exception of bulky goods and products with extra weight or agreed shipping method.

Even with the 5.- postage costs / additional service, we reserve the right to decide whether a delivery is made by letter or by parcel.

10. Postage-free delivery

For orders over 50.-, delivery is postage-free.

11. Express delivery method

The express delivery method is only available in the Winterthur area (zip code 8400 - 8411).

12. Product modifications

For all products presented and described, we reserve the right to make technical and formal changes.

13. Prices

VAT is already included in the price.

In the event of an obviously erroneous price announcement, Tamar Trade GmbH reserves the right to cancel the order.

Tobacco products and cigarettes may contain a reduced surcharge.

Overweight items, bulky goods and special items may contain a transport surcharge, which is added to the item price and displayed in the item view.

14. Complaints

If there is a problem with one of our items, we ask the customer to contact us first by phone or by

e-mail. Many things can be clarified in advance.

If an item is incomplete or defective, it will of course be replaced by us. For speedy processing, we ask the customer to enclose the invoice with a notice of defects (e.g. by hand) when returning the goods

Exchanges are only possible in the event of incorrect delivery. For returns, the invoice or delivery note must be enclosed, otherwise processing is not possible. In the event of damage to goods in transit, a complaint must be made within 3 days, otherwise any claim for replacement  will expire.

Returns due to dissatisfaction are excluded.

In the case of postage-free delivery, free returns are not possible.

15. Repair e-cigarettes / electric cigarette stoppers

We reserve the right to remove heavily soiled and clogged items (e-cigarettes, electr. cigarette butters), which are within the warranty period, into a fee-based repair.

Unplug electric cigarette stoppers and check for functionality.

Add e-cigarette spare parts (while stocks last) and check for functionality.

Spare parts used in e-cigarettes are included in the price, including atomizer heads, seals without liquid. Functional test is carried out with Standard Liquid. The liquid cannot be selected. Batteries are excluded and must be charged separately. 

We reserve the right to charge shipping costs and special services. If the device is very dirty or unmaintained, processing can be refused. This is at the discretion of the employee. A cost summary will be emailed to the customer in advance. The processing will only be carried out after confirmation by the customer. The same payment terms apply as for normal orders via the online shop.

16. Transport damage

The goods are always shipped at the risk and risk of the recipient, and Swiss Post is liable for transport damage.

17. Age of Majority

By accepting the terms and conditions, I confirm that I have exceeded the age of 18.

18. Terms of payment

Payment for the order is generally made by prepayment, Twint, credit card, Applepay, Googlepay or Postfinance. .

If you pay by credit card, the card will only be debited when the goods are delivered. In the case of partial deliveries, the charge is made separately for each shipment.

The prices shown for postage and shipping costs do not apply to bulky goods and overweight items – the items in question are marked.
