Terms & Conditions

It is our aim to always serve you to your complete satisfaction. This also includes our fair terms and conditions. We only supply brand new products in original brand quality.

The contract is concluded when we accept the contract offer made by your order by our order confirmation. This order confirmation contains the essential contents of your order.

Refusal

In the event of unjustified refusal to accept the goods delivered by us, we shall charge the costs incurred by us.

Privacy

Tamar Trade GmbH only records the absolutely necessary data and uses it in the context of processing the order and with the purpose of making shopping as easy as possible for the returning customer.

The personal data will be treated confidentially by Tamar Trade GmbH in accordance with data protection legislation.

Tamar Trade GmbH does not pass on any data to third parties. Under no circumstances will your data be used for third-party advertising or resold.

Ownership

The delivered goods remain our property until full payment has been made.

Warranty

The warranty is valid for two years after delivery and is limited during this period to defects that can be proven to be due to material, workmanship or design defects on the part of the supplier.

Venue

Our business activities are based exclusively on Swiss law. The place of jurisdiction is Winterthur.

We are also entitled to sue at your general place of jurisdiction.

Warranty/Liability

In the case of the delivered goods, liability is limited to a repair or replacement. Legal claims are excluded. Claims for rescission of the contract or reduction of the remuneration are excluded, provided that a replacement delivery is possible within a reasonable period of time.

Objections due to defects in the goods can be made within 3 days, provided that the goods are new and unused. If the inspection of the defective goods shows that the defects are due to culpable conduct on the part of the buyer (e.g. damage caused by improper handling), the buyer shall bear the costs of the replacement delivery.

Glassware of any kind is completely excluded from warranty and liability.
Glass/ceramic goods and electronic cigarettes are covered by a DOA (dead on arrival) warranty

Our liability for our own fault, as well as that of our legal representatives and vicarious agents, is limited to intent and gross negligence. This does not apply to the breach of essential contractual obligations and the absence of warranted properties.

Please note that we cannot take back plants, cigars, personalized items of any kind (soccer shirts, home shirts, etc.), as well as underwear and bed linen for hygienic reasons. Also excluded from the right of return for copyright reasons are software, multimedia products, sound carriers, videos and DVDs

Purchase on account with installment option (PowerPay)

Orders against invoice (PowerPay) are accepted exclusively via the websites www.tamarheadshop.ch, www.tamargrowshop.ch and www.cbd.ch and are exclusively for adult customers. If, after the order confirmation, it is determined that an item is not available, the corresponding order will be adjusted and cancelled if necessary.  The customer cannot assert any further claims.

In the case of purchase on account (PowerPay), the customer is obliged to pay the invoice amount within 10 calendar days of receipt of the delivery, otherwise the installment payment option comes into effect.

As an external payment service provider, MF Group / PowerPay offers the payment method "Invoice from PowerPay". With the order invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, PowerPay takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept the terms and conditions of PowerPay (powerpay.ch/de/agb) in addition to our terms and conditions.

Collection

After expiry of the payment period, the customer is automatically in default. Tamar Trade GmbH is entitled to charge reminder costs of up to CHF 20 per reminder. The outstanding invoice amount plus any reminder fees and interest may be handed over or assigned to Intrum Justitia AG for the purpose of collection. In this case, at least CHF 50 reminder fees will be incurred. Furthermore, the customer is obliged to reimburse all costs incurred by Tamar Trade GmbH or Powerpay as a result of the delay in payment.

Terms of delivery

Please note the delivery times, which are indicated on our site for the respective product. These are empirical values, which, however, can vary due to residues. A delay in delivery never leads to a reduction in the sales price.

In order to deliver the goods as quickly as possible, we also make partial deliveries. There are no additional costs for you. Delivery is made by post.

In principle, delivery is made by A-Post, letter or parcel, with the exception of bulky goods or agreed shipping methods.

Even with the 9.- postage costs / additional service, we reserve the right to choose whether a delivery is made by letter or by parcel delivery.

Postage-free delivery

For orders over 150.-, delivery is free of charge.

Delivery method Express

The Express delivery method is only available in the Winterthur area (postcode 8400 - 8411).

Product modifications

For all products shown and described, we reserve the right to make technical and formal design changes.

Prices

VAT is already included in the price.

Complaints

If there is a problem with one of our items, we ask the customer to contact us first by phone or e-mail. Many things can be clarified in advance.

If an item is incomplete or defective, it will of course be replaced by us. For a speedy processing, we ask the customer to enclose the invoice with a notice of defects (e.g. by hand) when returning the shipment

Exchanges are only possible in the event of incorrect delivery or manufacturing defects. In the case of returns, the invoice or delivery note must be enclosed, otherwise processing will not be possible. In the event of damage to goods in transit, a complaint must be made within 3 days, otherwise any claim for replacement by the post office will expire.

Returns due to dissatisfaction are excluded.

In the case of postage-free delivery, a free return is not possible.

Damage

The dispatch of the goods is always at the risk and peril of the recipient, and Swiss Post is liable for transport damage.

Majority

By accepting the terms and conditions, I confirm that I have exceeded the age of 18.

Terms of payment

Payment for the order is generally made in advance, by credit card or Postfinance. Abroad only against prepayment.

If you pay by credit card, the card will only be charged when the goods are delivered. In the case of partial deliveries, the charge will be made separately for each shipment.

The prices quoted for postage and shipping costs do not apply to bulky goods and soil – the items in question are marked.

Prepayment Switzerland (CHF 9.- postage/shipping costs, exception: bulky goods & soil):

After placing your order, you will receive a confirmation from us with the total amount to be paid for the ordered items including postage of CHF 9.00. You can transfer the amount to the account specified in the confirmation or request a payment slip. As soon as we have received your payment, your package will be shipped the same day. To make it faster, you have the option of emailing your payment confirmation.

In a second confirmation, we will inform you of the postage charges, which will then be added to the invoice amount of your order. Credit cards/Postfinance (CHF 9.- postage/shipping costs)

When paying by credit card or by Postfinance, a flat rate of CHF 9.00 will be charged for postage/shipping costs, as with advance payment. The package will be sent to the post office as soon as we have been able to debit the amount of your credit card or postal account definitively.
